1.2. Alnair is an online Portal in the real estate sector, providing informational, analytical, communication and technological services to users, brokers, developers and partners.

1.3. Any references to the “Portal” in these Terms shall mean the Alnair service, including all its sections, tools, mobile applications and related services.

2. Acceptance of the Terms

2.1. By using the Portal, you acknowledge that you have read, understood and agree to be bound by these Terms of Use (the “Terms”).
2.2. If you do not agree with these Terms, you must immediately stop using the Portal.
2.3. Use of the Portal by minors is prohibited.

3. Personal Data Processing

3.1. Personal data processing is carried out in accordance with our Privacy Policy.
3.2. By using the Portal, you consent to the processing of your personal data as described in the Privacy Policy.

4. Intellectual Property

• publishing fake properties or misleading information;

• creating duplicate listings;

• providing false pricing or conditions;

• manipulating property descriptions or media;

• interfering with Portal systems or bypassing technical restrictions;

• hacking, malware, DDoS attacks;

• sending spam through the Portal.

7. Role of the Portal and Disclaimer Regarding Transactions

7.1. The Portal is an informational and technological service, providing access to a database of properties, projects, descriptions, analytics and communication tools.

7.2. The Portal is not:

• a broker;

• a real estate agency;

• a party to any transaction;

• a representative of buyers or sellers;

• a legal advisor;

• a financial intermediary;

• an advertising agency;

• a marketing tool for promoting any specific property.

7.3. The Portal does not participate in:

• negotiations between parties;

• verification of ownership rights;

• legal due diligence;

• financial settlements;

• booking of units;

• preparation or signing of contracts.

7.4. All real estate transactions (purchase, sale, rent, reservation) are concluded directly between the user and the relevant broker/agency/developer.

7.5. The Portal may act solely as a lead-intake channel, registering and forwarding user inquiries to relevant partners. The Portal is not a party to any transaction and bears no responsibility for the actions of third parties.

8. Information About Properties and Disclaimer

8.1. All information about properties is provided by developers, brokers, agencies or partners.

8.2. The Portal does not guarantee:

• accuracy of prices;

• availability of promotions or discounts;

• correctness of completion dates;

• actual availability of units;

• correspondence of layouts;

• accuracy of photos, renders or descriptions;

• completeness or relevance of property information.

8.3. Users must independently verify all information before making any decision.

9. Third-Party Integrations

9.1. The Portal uses third-party services (CRM, telephony, call-tracking, WhatsApp integrations, analytical systems, email platforms, etc.).

9.2. The Portal is not liable for:

• malfunctions of third-party systems;

• data loss within integrations;

• temporary unavailability;

• errors in lead processing caused by third-party services.

10. Publication of Properties by Users and Brokers

10.1. Brokers/agencies publishing listings warrant that:

• the property exists;

• they have legal authority to publish it;

• pricing and conditions are accurate;

• photos correspond to the actual property;

• information is not misleading.

10.2. It is prohibited to:

• publish fake properties;

• publish “bait listings”;

• create duplicate listings;

• intentionally misstate prices;

• substitute photos or media;

• manipulate transactional information.

10.3. The Portal may remove any violating content without refunds.

11. User-Generated Content

11.1. By uploading content to the Portal, you grant the Portal a non-exclusive, worldwide, royalty-free license to publish, store, modify, adapt, and use such content in analytics, demonstrations and Portal materials.
11.2. The Portal may delete any content at its sole discretion.

12. Consent to Receive Informational and Marketing Communications

12.1. By using the Portal or submitting your contact details, you expressly agree to receive from the Portal and its partners:

• promotional SMS messages;

• marketing email newsletters;

• messages via messengers (including WhatsApp);

• informational notifications;

• commercial messages;

• phone calls.

This is an inherent part of the Portal’s functionality.

13. Subscriptions, Recurring Payments and No Refund Policy

13.1. Paid services of the Portal are provided on a subscription basis.
13.2. Payments are made in advance.
13.3. Subscriptions renew automatically, and recurring charges apply according to the selected billing cycle.
13.4. Payments are non-refundable, in full or in part.
13.5. Cancellation prevents future charges but does not refund the current period.

14. Blocking and Access Restrictions

The Portal may temporarily or permanently restrict or block access for:

• violations of the Terms;

• user complaints;

• fraudulent behavior;

• fake or misleading listings;

• bypassing technical protections;

• abusive or harmful activity.

Blocking occurs without refunds.

15. Changes to Functionality, Pricing and Availability

The Portal reserves the right to:

• modify functionality;

• introduce new tools;

• discontinue outdated features;

• update subscription pricing;

• limit access during maintenance;

• change the structure or logic of services.

The Portal is not liable for losses associated with such changes.

16. Limitation of Liability

The Portal is not liable for:

• lost profits;

• developer or broker actions;

• inaccurate third-party information;

• user mistakes;

• equipment or system failures;

• transactions between third parties;

• the user’s decision to purchase or not purchase any property.

17. Disputes, Claims and Jurisdiction

17.1. These Terms are governed by the laws of IFZA (Dubai, UAE).
17.2. All disputes shall be resolved in the courts of IFZA / Dubai.
17.3. Claims must be submitted in writing to support@alnair.ae.
17.4. The period for submitting claims is 1 year.

17.5. Priority of the English Version

In the event of any inconsistency, discrepancy or conflict between the English and Russian versions of these Terms, the English version shall prevail.
The Russian version is provided solely for convenience.

18. Changes to the Terms

The Portal may update these Terms at any time. The updated version becomes effective upon publication.
